The Site is operated by NI Commerce SASU, a company registered in France and trading as "Avivia" ("Avivia," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Dispute Resolution and Class Action Waiver

Any dispute arising out of or relating to these Terms, the Site, or any product shall be resolved on an individual basis. You and Avivia agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You agree to waive any right to participate in a class action.

Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them or to your use of the Site or products shall be governed by and construed in accordance with the laws of France, without regard to its conflict-of-laws rules. You agree that the courts of Paris, France shall have exclusive jurisdiction over any such dispute, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above indicates when they were last revised. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and Avivia regarding the Site.
